 🕵️ Why don't Czech courts contact all potential heirs abroad?

Czech authorities cannot reliably trace heirs from countries like the USA because:

  • There is no central registry of heirs in the U.S.

  • U.S. government agencies do not cooperate with Czech courts As a result, the court usually issues a public notice calling for heirs to come forward within six months.

Once the public notice period ends:

  • The court finalizes the list of heirs who actively applied

  • The estate is awarded to those who responded

  • Heirs who did not apply lose their claim

⏳ When can the Czech state take over a property and how to prevent this? 

If no inheritance proceedings are initiated within 10 years of the owner's death, the property may be considered abandoned. In such cases, the Czech state has the legal right to confiscate the property.

This is regulated by the Czech Civil Code (Act No. 89/2012 Sb.)

To avoid state confiscation:

  • Initiate inheritance proceedings as early as possible

  • Correct outdated or missing entries in the Land Registry

📉 What qualifies a property as "abandoned"?

A property may be treated as abandoned if:

  • It remains registered under a deceased owner and no one has initiated inheritance proceedings

  • Land registry records contain incorrect, incomplete, or outdated ownership data
